The amount paid to the notary as the “provision for costs” and commonly and incorrectly called “notary fees” actually includes:
  • The taxes,
  • Disbursements,
  • The formalities,
  • The notary's remuneration.
This remuneration can take two distinct forms: emoluments or fees. The fees correspond to a sum calculated on the basis of a percentage and a lump sum per formality completed, all set by decree by the government.

The notary's emoluments are therefore the same for all Notaries in France.

This method of remuneration has a redistributive purpose, it allows the remuneration of important files to cover the cost of more modest files whose amount of fees does not cover the real cost of the service.

The fees are freely set by the notary. They apply in particular in commercial matters or for advice. When the act has been signed and the administrative formalities completed, you will be sent a final account statement which is often (but not always) accompanied by a refund of overpayments on fees. Sometimes this shipment will reach you late due to the processing time of the administrations concerned (land registration service for a sale or tax center for an inheritance declaration for example).
